The founder of Innovative Teachers Union, Stephen Desu has described the dismissed court case by the Accra High Court on Thursday, 23rd December, 2021 as just a minor setback and has confirmed that the case will be relisted in court in January.
The Accra High Court on 23rd December, 2021 dismissed the lawsuit filed by Innovative Teachers Union and All Teachers Alliance Ghana (ATAG) on the bases that the plaintiffs had not demonstrated to the court the capacity with which they filed the case.
Innovative Teachers and ATAG jointly filed the lawsuit in an attempt to nullify the contract awarded KA Technologies Ghana, the company contracted to produce the TM1 Laptops.

The Case to be Relisted in Court
Prior to the hearing of the case on the 23rd December, the plaintiffs (Innovative Teachers and ATAG) had already filed a motion to the High court on 21st December, 2021 to remove KA Technologies Ghana as part of the defendants of the case and also asked the court for permission to amend their writ and the motion for the interlocutory injunction.
Mr. Desu explained that this was done because KA Technologies had filed for the case to be dismissed by the High court because the plaintiffs did not have the power to sue the 1st defendant (KA technologies).
That motion filed by the plaintiffs was meant to render KA Technologies Ghana’s application to the court that the plaintiffs’ case should be dismissed irrelevant.
“However, our application was not made available to the document during the hearing for some reasons unknown to us. This is what made the judge dismiss our case on the bases that our application to remove KA Technologies from the case and face Ministry of Education and GES was set aside.” Mr. Desu explained
“But since our lawyer was not in court, the rules of court permits us to go back to the court and ask for what is called a relist and we will file the motion next week so that when the court resumes from the break on the 2nd week of January, we will continue with the proceedings.” He also added
Mr. Desu assured teachers that nothing is lost and that the case is still in court so this should just be seen as a minor temporal setback and Innovative Teachers and ATAG are determined to fight for teachers.
The relisting of the application also means that the plaintiffs will not pay the Ghc15,000 fine they were charged with.
